We begin by providing you with an introductory care pack and confirming your identity in line with AML regulations.
If you’re selling, we’ll prepare the contract pack and begin communicating with the Buyer’s solicitor.
If you’re buying, we’ll carry out all essential searches to highlight any potential issues before you commit.
We ensure everything is clear before you sign, including finances, legal issues, and paperwork.
We manage all enquiries, coordinate parties to the transaction, and help you prepare for signing and completion.
Once both parties are ready, we exchange contracts, transfer funds, and finalise everything for a smooth handover.
Once you have chosen to engage Witts with your conveyancing, here are the principal stages of the process explained step by step.
We begin the process by asking you to complete our introductory client care pack, which includes the business terms and conditions you agree to proceed with, the specifics of our instructions to act on your behalf and basic questionnaires which will collect standard information about you and the transaction.
We will also verify your identity, which can be done both electronically and in-person. We closely follow the regulatory AML guidelines, to ensure that your matter is and remains compliant.
If you are selling, once we receive all completed forms from you, we will begin to prepare the draft contract pack, which will be sent out to the Buyer’s solicitor.
If you are buying, once the draft contract is received from the Seller’s solicitor we will proceed to order searches on the property to verify whether there are any issues which we will need to deal with before you decide to go ahead with the purchase.
If you are selling, we will:
- Answer Enquiries – explain and help you understand the questions raised by the Buyer. Once we receive your instructions, we will prepare suitable replies which will be sent to the Buyer’s solicitor.
- Chase & Coordinate Parties – we will actively monitor and pursue the Buyer’s solicitor and agents to ensure that deadlines are met and that you are aware of any developments.
- Miscellaneous – we will do our best to assist you with any questions you may have about the process and will direct you where necessary to ensure everything is ready for you to exchange.
- Prepare exchange – we will provide you with the contract and transfer for you to sign and will confirm with you any costs which you will need to settle on completion, such as the amount of the mortgage to be redeemed and estate agent fees.
If you are buying, we will:
- Raise enquiries – to clarify any outstanding points with the Seller through their solicitor
- Answer your Queries – we will help you understand your property better from the legal perspective and notify you of anything which you must be aware of
- Report – we will provide you with a detailed property report, which will illustrate our findings, explaining if there are any legal or related issues which may be of concern.
- Prepare exchange – we will provide you with the contract and transfer for you to sign, and we will ask you to confirm the method of financing of the purchase. If you are a mortgage buyer, we will report on the terms of the mortgage to you.
- Getting finances into place – we will provide you with an initial statement, informing you of the amount needed to exchange, and will give a detailed breakdown of the monies needed for completion. We will ask you to transfer the deposit monies to us ahead of exchange.
Once all matters have been resolved, a completion date is agreed to by both parties and we have your authority to proceed, we will exchange contracts with the other side solicitor. From this very moment, both parties will be legally bound to complete the transaction.
This is the final stage of the conveyancing process, where the completion funds are transferred, keys are released, and the Buyer moves into the Property. On the day of completion, we work closely with all parties to ensure a smooth and stress-free transition.
