Here are the usual steps which you can expect from a standard transaction (non-exhaustive):
- Obtaining a completed Property Information Form, Fittings and Contents Form and Leasehold Information Form (if your property is Leasehold) from you.
- Preparing a draft contract for the sale.
- Preparing a title pack for the sale, to include all title documents necessary for a deduction of your title.
- Replying to the Buyer’s pre-contract enquiries.
- Obtaining your instructions to proceed to exchange of Contracts and agree a completion date.
- Arranging your signature to any completion documents including the Transfer Deed.
- Exchanging contracts with the Buyer’s solicitors and agreeing the completion date.
- Obtaining all necessary financial statements and invoices to prepare a completion statement for you.
- Agreeing any apportionment of Ground Rent and/or Service Charge with the Buyer’s solicitors.
- Receiving the Buyer’s completion monies and reporting completion to you.
- Redeeming any mortgage on the property and making any other payments to third parties on your behalf
- Transferring to you the proceeds of sale
Here are the usual steps which you can expect from a standard transaction (non-exhaustive):
- We will contact your Seller’s solicitor and request the draft Contract and supporting documents.
- On receipt of the draft Contract and supporting paperwork we will conduct a thorough review of the documentation supplied.
- We will review the Lease and all associated Leasehold documentation (if applicable).
- We will submit local, environmental, water, chancel or any other search that may be necessary.
- We will raise enquiries with the Seller’s solicitors.
- We obtain a Management Information Pack via the Seller’s solicitors from the Landlord in respect of Ground Rent, Service Charge and all Leasehold matters (if applicable).
- We will consider your mortgage offer and address any special conditions.
- We will also review replies received from the Seller’s solicitors to our enquiries and seek further information if required.
- We assess the results of various searches and raise enquires on any matters arising as appropriate.
- We will prepare a comprehensive report on title for you which will be provided together with all supporting documents associated with the property.
- We will advise and report to you on the terms of any Freehold Rentcharge or Estate Service Charge.
- Address any queries you may have on the report on title.
- We will advise you in respect of any post-completion requirements of the Landlord and/or the Managing Agent due under the Lease (if applicable).
- We receive your instructions to proceed to exchange of Contracts and agree a completion date.
- We will exchange Contracts with the Seller’s solicitors and agree a completion date.
- We will prepare the Certificate of Title and submit it to your lender and deal with any further queries that may raise.
- We will organise formal completion by transmission of funds to the Seller’s solicitors. We will also contact the Seller’s solicitors to confirm completion, release of keys and release of documents.
- We will attend to submission of the Stamp Duty Land Tax return to HMRC and paying any Stamp Duty that is due.
- We will attend to post-completion requirements of the Landlord and/or Managing Agents (if applicable).
- We will submit the application for registration of the Transfer to the Land Registry and will deal with any requisitions raised.
Here are the usual steps which you can expect from a standard transaction (non-exhaustive):
- We will review the title, to ensure that you are legally entitled to re-mortgage the property and to ensure that there are no covenants or rights affecting use of the property.
- Check that all obligations noted on the title have been complied with.
- Carry out searches where required by the lender.
- Where searches are required, we will review the results to ensure, amongst other things, that all necessary consents are in place.
- We will review the mortgage offer and ensure compliance with any special conditions.
- We will report to the Lender any issues which have been uncovered and confirming how we intend to deal with these.
- Report to you in full on the terms of the mortgage offer.
- Write to any occupiers with the occupier’s consent for signing.
- Obtain a redemption statement from any existing lender.
- On receipt of the signed mortgage deed, occupier’s consent, and cleared funds, will agree a completion date with you.
- We will report to the lender to request the release of the mortgage advance.
- Complete the transaction and date the mortgage deed; redeem any existing mortgage; ensure that any indemnity policies are in place from the date of completion.
- We will then proceed to register the transaction with the Land Registry with any evidence of discharge of any previous charge
- Finally, we will forward to you and the Lender a copy of the updated Register of Title.
Here are the usual steps which you can expect from a standard transaction (non-exhaustive):
- We will take your instructions and establish who is acting for the other party, alongside their contact details and their ID documents (if they are unrepresented).
- We will obtain evidence of title and check if any Lender’ consent is required.
- Review the legal title to the property, to ensure that the transferor is legally entitled to transfer the property; and to ensure that there are no covenants or rights affecting use of the property.
- We make sure that any restrictions on the title are reviewed and complied with to enable the transfer to take place.
- Prepare the Transfer and obtain signatures of all parties.
- We consider the Stamp Duty Land Tax position and complete an SDLT return if necessary.
- We will enquire whether the other party has legal representation or is advised to obtain independent legal advice.
- We also prepare a completion statement for you.
- We will complete and pay the SDLT if applicable.
- If we are acting for the Transferee, we will register the Transfer at the Land Registry.
- Finally, we will provide a copy of the registered title to you, the other party’s solicitor and lender if appropriate.
